Hallo, Ich habe einen kleinen Webshop in Niederland, und ich möchte gern wissen ob es möglich ist das ich eine Abmahnung bekomme... Mein shop ist in NL, und ich habe keine Sitz in Deutschland, aber der Seite ist in Deutsch erhältlich. Wer weisst es? (Territorialitätsprinzip?)
Mein Deutsch ist nicht so gut, also ein bisschen extra Information auf English:
My main question is: do I need to follow German laws (widerrufsbelehring on checkout, extensive impressum etc.)? And does this also imply I could expect a (legally 'valid') Abmahnung if something's not okay? As told: my site is available in German language, but the company is seated in the Netherlands. I do not have a german address or other relations with Germany other than the fact that I have some customers there.

It is up to you which language you choose in your webshop. You will have to follow the German law if you are are going to offer your products in Germany e.g. with a '.de' shop. If you have a '.nl' shop then the German law will not matter for you. You have to follow the Netherland's law, but I do not know anything about the law there.
But of course, if you you do something not in accordance to the Netherland's law, then there is a possibilty that you will get a penalty from a competitor.

It is indeed a .nl site and aimed at customers throughout Europe, not only Germany. So it seems logic that dutch laws apply. Which are not that different from the German ones. The only difference that bothered me was 'Abmahnwelle'.

Grundsätzlich gilt das Herkunftslandprinzip zumindest in der EG. Wenn man sich mit seinen Angeboten nur an deutsche Abnehmer in deutscher Sprache wendet, dann gilt nach deutschem Recht (EU-Recht) deutsches Recht.
Wenn man sich gezielt an ausländische Abnehmer richtet, dann gilt gemäß EU-Recht das Recht des Landes an das, das Rechtsgeschäft am stärksten geknüpft ist. Insoweit gibt es auch Ausnahmen zB. bei Arzneimitteln gilt EU weit das Bestimmungslandprinzip (siehe auch §4 Abs. 3 und 4
Teledienstegesetz).
